Accident Lawyer

People are accidentally injured or killed every day in the United States. Some accidents are mishaps due to nothing more than bad luck or victims’ own carelessness, while a great many others are caused by the negligence of entities or individuals other than the victims or by dangerous and defective products to which victims have been exposed. When injury-causing accidents are brought about by defective products, negligence, or other wrongdoing, the injured victims or deceased victims’ survivors may be entitled to financial compensation from the responsible parties.

If you have been injured or one of your family members has been killed in any type of accident and you suspect that the accident was caused by someone’s negligence or a defective product, you may be able to recover damages through legal action. The Killino Firm’s accident lawyers have extensive experience with a wide variety of accident cases, including those arising out of traffic accidents caused by driver negligence or defective motor vehicles, accidents caused by negligently maintained premises, and accidents caused by other negligence or defective products. Legal Responsibility for Accident Injuries and Deaths

Manufacturers and others involved in the production and distribution of dangerous and defective products may be held legally responsible for accident injuries and deaths caused by product defects. Negligent individuals and entities found to have caused accident victims’ injuries or deaths through their lack of care for others’ safety may also be held liable for the damages suffered by injured victims or deceased victims’ families as a result.

Liability for Injuries and Deaths Sustained in Traffic Accidents

Traffic accidents are one of the most frequent causes of injury and death in this country, and a great many of these accidents result from driver negligence or defects in motor vehicles. In complex traffic-accident cases involving multiple vehicles, the negligence of one or more drivers may combine with defects in cars or vehicle safety equipment to cause victims’ injuries and deaths.

Every driver has a duty to exercise reasonable care for the safety of passengers, the occupants of other vehicles, and pedestrians and may be found to have been negligent for any breach of this duty of care. When a driver’s breach of the duty of care, or negligence, is determined to have been a cause of an accident victim’s injury or death, the driver may be required to compensate the injured person or deceased person’s survivors for the damages suffered as a result.

A driver found to have been operating a motor vehicle while under the influence of alcohol, for instance, may be found to have negligently caused a traffic accident and victims’ resultant injuries. This may be so even if the driver’s blood-alcohol concentration (BAC) was within the legal limit, if the driver is found to have been sufficiently impaired by the amount of alcohol in the driver’s system to have caused the accident. A driver’s traffic-light violation, un-signaled lane change, speeding, cell-phone use, GPS or radio-station adjustment, or even distracting conversation may lead to a driver’s liability for accidents and resultant injuries and deaths determined to have been caused by such negligence.

Traffic accidents may also be caused by defects in one or more of the vehicles involved. In some cases, accidents caused by particular vehicle defects, or by drivers’ negligence, may result in injuries to victims that are enhanced by other defects in their own vehicles. When traffic accidents and/or injuries are determined to have been caused by vehicle defects, the vehicle manufacturers and others involved in the vehicles’ production and distribution may be held strictly liable for the resulting injuries and deaths in products-liability personal-injury or wrongful-death actions. Thus, a traffic accident caused by a defective steering mechanism in one of the vehicles involved and an accident victim’s injuries enhanced by a defective airbag in a second vehicle in which the victim was riding may lead to the liability of the manufacturers and others involved in the production and distribution of both vehicles for the victim’s resultant injuries.

Liability for Accidents Caused by Other Defective Products

Accidents and resultant injuries and deaths may also be caused by defects in products other than motor vehicles. Thus, if a non-vehicle product is found to contain a defect in its design, manufacture, or warnings, the product’s manufacturer and others involved in the product’s production and distribution may be found strictly liable for an injury or death determined to have been caused by the product defect. A gas fireplace that injures a consumer when it explodes due to a design or manufacturing defect, for example, may lead to the liability of the manufacturer and others for the damages suffered by the injured person as a result.

Liability for Accidents Caused by Negligence

In addition to accidents caused by driver negligence, accidents caused by other types of negligence may also result in personal injuries and wrongful deaths for which negligent individuals or entities may be held legally responsible. Owners, operators, and employees of businesses, for example, may be found liable for business patrons’ injuries and deaths determined to have been caused by owner, operator, or employee negligence. A shopping-mall patron who sustains an injury on a negligently maintained mall escalator, for example, may be entitled to damages from mall owners, operators, and individuals or entities responsible for the maintenance and repair of mall escalators. Zoo owners, operators, and employees whose negligence is found to have caused or contributed to patrons’ injuries from falls on negligently maintained grounds or from contact with negligently housed or restrained animals may be found liable for damages suffered by such patrons as a result of their injuries.
